1. Overview of Services

Medical Mary provides an online platform that connects patients with licensed healthcare providers for medical marijuana evaluations. We facilitate the consultation process and assist with state medical marijuana card applications. Medical Mary is not a healthcare provider and does not provide medical advice, diagnoses, or treatment.

2. Eligibility

To use our Services, you must:

• Be at least 18 years of age (or the minimum age required by your state)
• Be a legal resident of one of our supported states
• Provide truthful, accurate, and complete information
• Have a legitimate medical condition that may qualify for medical marijuana in your state

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Medical Evaluations

Medical evaluations are conducted by independently licensed healthcare providers. These providers exercise their independent medical judgment when evaluating patients. Medical Mary does not guarantee approval. The decision to issue a medical marijuana recommendation is solely at the discretion of the evaluating physician.

5. Fees & Payment

• The evaluation fee is $149 per consultation, unless otherwise stated for your state
• Payment is collected at the time of registration, prior to your evaluation
• Prices are subject to change; current pricing is always displayed before checkout
• State registration fees (if applicable) are separate from our evaluation fee and are paid directly to your state

6. Refund Policy & Money-Back Guarantee

Refunds do not apply if:

• You provided false or misleading information during your evaluation
• You were approved but chose not to proceed with state registration
• You failed to attend or complete your scheduled evaluation
• Your state's registration fee (paid to the state, not to Medical Mary)

7. User Conduct

You agree not to:

• Provide false, misleading, or fraudulent information
• Use the Services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Impersonate any person or entity
• Use automated systems (bots, scrapers) to access the Services
• Share your account credentials with others

8. Intellectual Property

All content on our Services — including text, graphics, logos, the Medical Mary character, images, software, and design — is the property of Medical Mary or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

9. Disclaimers

Medical Disclaimer: Medical Mary is a technology platform that facilitates access to licensed healthcare providers. We do not provide medical advice, diagnoses, or treatment. All medical decisions are made by independently licensed physicians. Always consult with a qualified healthcare provider regarding your medical condition.

No Guarantee of Approval: We do not guarantee that you will be approved for a medical marijuana recommendation. Approval is at the sole discretion of the evaluating physician based on your medical history and your state's qualifying conditions.

Compliance: Medical marijuana laws vary by state and are subject to change. It is your responsibility to understand and comply with the laws in your state. Medical Mary makes no representations about the legality of cannabis use under federal law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICAL MARY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Medical Mary, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Florida. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

14. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and HIPAA Notice, constitute the entire agreement between you and Medical Mary regarding your use of the Services.

PHI includes any individually identifiable health information that relates to your past, present, or future physical or mental health condition, the provision of healthcare to you, or payment for healthcare. This includes information provided during your medical marijuana evaluation.

3. How We May Use and Disclose Your PHI

For Treatment

We may use and disclose your PHI to facilitate your medical marijuana evaluation, including sharing information with the licensed physician conducting your consultation.

For Payment

We may use and disclose your PHI to process payment for your evaluation and related services.

For Healthcare Operations

We may use your PHI for quality assessment, training, compliance audits, and other operational activities necessary to run our practice.

As Required by Law

We may disclose your PHI when required to do so by federal, state, or local law, including reporting to state medical marijuana programs as authorized by you.

With Your Authorization

Other uses and disclosures of your PHI not described in this notice will be made only with your written authorization, which you may revoke at any time.

• Right to Access: You have the right to inspect and obtain a copy of your PHI maintained by us
